Package Tour Contract

BUKLA-MANIA TOURISM TRAVEL AGENCY PACKAGE TOUR CONTRACT

1- PARTIES AND SUBJECT: This contract has been concluded in accordance with Law No. 6502 and the Package Tour Contract Regulation, between Bukla Tourism and Trade Ltd. Company (hereinafter referred to as Bukla Tur), located at Esentepe Mah, Büyükdere Cad 175/7 Şişli, İstanbul, and the consumer who purchases the service. The contract becomes valid upon reservation request via distant means such as phone, email, message, or electronically.

This contract, voucher, and brochure can be sent remotely with a permanent data storage device and the employment relationship can be established in this way. The contract and information made with the consumer are deemed to have been made with all consumers represented by the party and their representatives. Bukla Tur cannot be held responsible for faulty or incomplete consumer information.

2- BUKLA TUR'S RESPONSIBILITIES: The subject of this contract covers the rights and obligations of the parties regarding the sale and performance of the service, whose characteristics and sales price are specified below, sold electronically by Bukla Tur to the consumer, and in accordance with the provisions of Law No. 4077 on the Protection of Consumers - Regulation on the Principles and Procedures for the Implementation of Distance Contracts. Bukla Tur is responsible to the consumer if the contracted service is defective. According to Law 1618, Bukla Tur takes out Mandatory Travel Insurance for consumers within the scope of the package tour. In case of baggage loss or damage due to the gross negligence of Bukla Tur; provided that the consumer has made Bukla Tur issue a loss or damage report, regardless of the material and moral value or other qualified features of the items inside the baggage, half (1/2) of the transportation portion of the service fee will be paid by Bukla Tur to the consumer as compensation for the lost items and luggage. Bukla Tur is liable up to the transportation fee for loss, theft, or damage of items declared in writing and delivered together with their values. Except for cases arising after the start of the service due to force majeure, or for which the consumer or third party is responsible, or due to violations or negligence caused by the air/land carrier, Bukla Tur is responsible for any reason within this contract that disrupts the provision of the service. In situations within Bukla Tur's liability, compensation to the consumer may be provided in the form of a refund or provision of a substitute service, pursuant to the provisions of the TÜRSAB KÜTAHYA TABLE. If additional or substitute services have been received, used, or consumed by the consumer, the consumer’s rights to a refund or compensation will be forfeited.

3- CONSUMER'S RESPONSIBILITIES The consumer declares that they have read and acknowledged all pre-contractual information regarding the product or service, its characteristics, sales price, and method of payment, and has given the necessary confirmation electronically. After the fulfillment of the contract, if the bank or financial institution does not pay Bukla Tur for the service due to unauthorized and unlawful use of the credit card used by the consumer not caused by Bukla Tur's fault, the consumer will be responsible for the disputed service fee and all damages, together with the statutory interest accruing from the date of reservation. With this contract, the consumer acknowledges that all matters regarding flights, passports, visas, and baggage, unless otherwise stated, are their responsibility; that they must comply with the laws and customs applicable to the facility where they will be staying and the vehicle they will be traveling in; that they will comply with the rules announced by guides, the facility, and Bukla Tur officials regarding the purchased service; that they will not endanger the life and property safety of third parties; that they will not behave in a manner that disrupts the order of the group and the tour; that they will follow the warnings and instructions of the guide, otherwise Bukla Tur will not fulfill the contract service and the consumer will not have the right to a refund for this reason; that the consumer will pay for all extra food and beverages, personal expenses, and all goods and services outside the tour program; that in the event they terminate the use of the service claiming it is defective, they are obliged to notify the reason for termination in writing to Bukla Tur officials and the hotel, otherwise it will be considered that the service was used; The consumer accepts, declares, and undertakes all the above. Consumers who did not sign the contract but participated in the service subject to the contract are deemed to have accepted and undertaken the contract provisions by having the participant(s) they authorized for registration read and sign this contract. Child discounts apply when staying as the third or fourth person in the same room as their parents. Free children will not have a bed in the hotel or a seat in the vehicle. Bukla Tur tours are sold excluding flights. Accordingly, Bukla Tur is not responsible for the cancellation, change, or refund of flight tickets purchased in the name of the participant or purchased by the participant. The participant is responsible for purchasing flight tickets in refundable and changeable flexible classes, checking flight times, and following up on changes. For domestic and international tours, the consumer undertakes to pay 30% of the total tour price to Bukla Tur at the time of reservation. Making a reservation renders the collection of this 30% due. In some cases, Bukla Tur may make some reservations on behalf of the consumer based on mutual trust before payment is collected. These reservations may be non-cancellable or partially refundable. In this case, the consumer accepts and undertakes that Bukla Tur's receivable arising from cancellation and change becomes due. The consumer also acknowledges and declares that they will pay the full tour price before the start of the tour. For early reservation purchases, the consumer is obligated to pay the full service fee on the reservation date. For products and services specially prepared for the consumer; the balance must be paid no later than 30 days before the start of the service. If payment is not made within the specified periods, in addition to the payments made for the product, 30% of the total offer for the product and service will be invoiced to the consumer as a cancellation fee.   

4. FORCE MAJEURE, TERMINATION, TRANSFER AND WITHDRAWAL: If Bukla Tur terminates the contract unjustly, Bukla Tur will refund all payments made to the consumer up to that date. In the event of termination due to the number of registered consumers not reaching the necessary number for the organization of the Package Tour, or if, despite Bukla Tur's best efforts, force majeure prevents the start or continuation of the service, the consumer has no right to compensation. Bukla Tur may, for justified reasons, change the order of places to be visited and the schedule of days, provided the content, quality, and nature of the tour subject to service do not change. In this case, the consumer has no right to objection or compensation. The consumer may transfer this contract, provided all conditions for the package tour are met and upon written notice, to a third party up to 7 days before the start of the tour. All responsibilities of the assignor transfer to the assignee. Date change requests by the consumer are considered a termination.
Domestic Tours; If the consumer terminates the contract at least 14 days before the start of the service, all fees paid, except for expenses arising from taxes, charges, and similar obligations, will be refunded. For cancellations made less than 14 days in advance, no refund will be made and the tour price will become due. In case of cancellations less than 14 days before the start of the tour, illness or death of the consumer or first-degree relatives not existing at the time of reservation and which prevents them from engaging in their usual occupation for 10 days, when proven by an official board report from a fully equipped Turkish State Hospital and submitted in writing before the start of the service, constitutes an exception. The consumer is insured for this situation and must submit their claim directly to the insurance company. Refund requests and evaluations are carried out by the insurance company. Bukla Tur has no involvement in this regard. 
For International Tours and Special Products; For international tours or special products prepared or ordered for individuals, companies, schools, families, friends, etc. groups at the consumer's request; if canceled 90 days or more before the start date of the tour, all payments will be refunded except for deposit amount and expenses arising from taxes, charges, and similar obligations. If terminated 59-30 days before, the consumer agrees, declares, and undertakes to pay 50% of the service fee, and if less than 30 days, to pay the full amount to Bukla Tur. No changes or cancellations can be made for early reservation, promotion, official holiday, and festival period tours.
The consumer can transfer the service to anyone they wish up to 7 days before the start of the service. The transferee is jointly responsible with the transferor for all expenses arising from the balance and the reason for transfer. The consumer is obliged to submit all termination/transfer requests to Bukla Tur in writing before the start of the service. If the consumer does not notify in writing that they will participate in the service they missed at the start, Bukla Tur has the right to cancel all reservations and services made in the name of the consumer and terminate the Contract 24 hours later. In such cases, no refund will be made to the consumer. If the consumer notifies within 24 hours from the service start that they will participate in the service again, any price differences arising from transportation services shall be paid by the consumer. The participant may withdraw from the package tour contract without penalty if any of the essential elements of the contract change, participate in an equivalent tour, or join a cheaper tour by receiving a refund. In case of withdrawal from the contract, the refund is made within 14 days. If the consumer does not accept these changes or cancellations for justified reasons, they have the right to cancel their reservation or, if in an ongoing package tour, to give written notice, terminate the package tour and request a refund for the unused service. The package tour price may be changed by notifying the participant at least 20 days in advance due to changes in exchange rates, extraordinary increases in fuel costs, or increases in legal obligations such as tax or fees. During the service, Bukla Tur may change the names of hotels and transportation vehicles within the service scope, the departure points of vehicles, and the order of visits of the places to be visited with their equivalents; no compensation right arises for the consumer due to these changes. 

5. MISCELLANEOUS PROVISIONS: If one or more provisions of this Contract are deemed void for any reason, the other provisions of the Contract will remain unaffected and in force. The consumer consents to receiving information about services, advertisements, announcements, campaigns, and activities regarding the brands operated by Bukla Tourism and Trade Ltd. Company, their suppliers, and partner organizations, via email, SMS, and similar methods. If the consumer wishes to cancel their consent, they undertake to inform Bukla Tur to terminate notifications. Turkish Law shall apply to all disputes arising from the enforcement of this Contract, and Istanbul European Courts and Execution Offices shall have jurisdiction. This contract, consisting of five (5) items, has been prepared in Times New Roman font, 12 points. 

This contract has been provided together with the voucher and brochure, which are given before signing and contain all information about the services to be provided, the nature and performance, such as the destination of the Package Tour included in the subject of this contract, duration of stay, included items in the price, places to visit, payment terms, transportation, accommodation and meal details, total price, currency, payment plan, sales price, and special requests.
